Welcome to Bluer! These Terms of Service ("Terms") govern your use of the Bluer app, website, and related services operated by TOY TECHNOLOGY LTD ("Company," "we," "us," or "our"). By creating an account or using Bluer, you agree to be bound by these Terms.

1. Eligibility & Age Restriction

You must be at least 18 years old to create an account and use Bluer. By using the app, you represent and warrant that you are legally an adult in your jurisdiction. Creating an account with false age information is a violation of our Terms and will result in immediate termination.

2. Zero Tolerance Policy & User Conduct

Bluer is a safe, inclusive space. We have a strict ZERO TOLERANCE policy for the following behaviors:

Homophobia, transphobia, racism, or hate speech of any kind.
Harassment, bullying, or threatening other users.
Uploading or sharing Child Sexual Abuse Material (CSAM) or any illegal content.
Scams, financial fraud, or requesting money/cryptocurrency from users.

Any violation will result in an immediate, permanent ban without warning.

3. AI Features & Disclaimer

Bluer offers AI-assisted features (e.g., Dating Wingman, Date Concierge) powered by third-party LLMs (OpenAI, xAI, MiniMax). Please note:

AI suggestions are for entertainment and assistance purposes only.
You are solely responsible for the messages you send and your real-life interactions with other users.
We do not guarantee the accuracy, safety, or availability of real-world venues suggested by our AI Concierge (via Google Maps API). Always verify venue details before meeting IRL.

4. User-Generated Content

You retain ownership of the photos, chats, and content you upload. However, by uploading content, you grant TOY TECHNOLOGY LTD a worldwide, royalty-free license to host, display, and process your content solely for the purpose of operating the app.

5. Purchases, Subscriptions & Refunds

Bluer may offer premium features via in-app purchases. All billing, subscriptions, and auto-renewals are handled entirely by the Apple App Store.

Cancellations: You must manage or cancel your subscriptions directly through your Apple ID settings. Deleting your Bluer account does not cancel your Apple subscription.
Refunds: TOY TECHNOLOGY LTD does not process payments and cannot issue refunds. All refund requests must be directed to Apple Support according to their policies.

6. Limitation of Liability

To the maximum extent permitted by law, TOY TECHNOLOGY LTD shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the app, your interactions with other users (online or offline), or the performance of our AI and third-party API features.
